These Terms & Conditions ("Terms") govern your access to and use of the Forge AI website, mobile experience and services ("Service"), operated by xlc fitness ("we", "us", "our"). By creating an account, subscribing, or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

The Service is provided by xlc fitness (the seller). References to "Forge AI" mean the Service operated by xlc fitness. When you purchase a subscription you are contracting directly with xlc fitness.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Forge AI provides AI-generated fitness and nutrition guidance, including personalized workout programming, BMI-based calorie and macro targets, meal suggestions and recipes, a recipe builder, workout and nutrition logging, a progress dashboard, and the ability to import health data from Apple Health or Google Fit. Some features require an active Forge Pro subscription.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information about yourself and to keep it up to date. Notify us promptly if you believe your account has been compromised.

You must not misuse the Service. Misuse includes, without limitation:

• using the Service for any unlawful purpose or in violation of any applicable law;
• fraud, spam, phishing, or deceptive activity;
• infringing the intellectual property or other rights of any third party;
• interfering with the security or operation of the Service, including probing, scanning, or testing vulnerabilities, or introducing malware;
• attempting to bypass, scrape, or reverse engineer any part of the Service.

The Service uses generative AI to produce workout plans, meal plans, recipes, and coaching feedback. You are responsible for the information you provide (including your prompts, body details, dietary restrictions, and injury notes), for how you use the outputs, and for verifying that any output is accurate and suitable for you before acting on it.

You must not use the Service to generate illegal content, deepfakes, hate speech, harassment, or content that could cause harm, and you must not attempt to jailbreak or manipulate the AI into producing such content. You represent that you have the rights to any content you provide as input.

Accuracy disclosure: AI-generated outputs may be inaccurate, incomplete, or unsuitable for your circumstances. They are not a substitute for professional medical, dietetic, or training advice. You should consult a qualified clinician before starting any new exercise or nutrition program, and you are solely responsible for decisions you make based on the outputs.

We may review, filter, refuse, or restrict content and outputs, and may suspend or terminate accounts, to enforce these Terms and protect the Service and its users. We may remove content that violates these Terms, and repeated infringement may result in account termination.

We (and our licensors) retain all ownership of the Service, its software, documentation, branding, and any content we produce, except for content you submit. You are granted a limited, non-exclusive, non-transferable right to use the Service for your own personal, non-commercial purposes, subject to these Terms.

If you believe content generated or hosted by the Service infringes your intellectual property rights, contact us through the contact details provided in the Service and we will review and take down infringing content where appropriate.

Forge Pro is a paid monthly subscription. Pricing is displayed at the time of purchase. By subscribing you authorize recurring charges for each billing period until you cancel. You can cancel at any time; cancellation takes effect at the end of the current billing period. Payment, billing, tax, cancellation, and refund mechanics are handled by our payment provider and are governed by Paddle's Buyer Terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We may suspend or terminate your access to the Service, in whole or in part, if you materially breach these Terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously violate our policies. Where reasonably possible we will give you notice. On termination, your right to use the Service ends immediately.

After termination, your account data may be retained for a limited period to allow you to export it, and will then be deleted or anonymized in accordance with our Privacy Notice, unless we are required to retain it by law.

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free performance, and the Service may be temporarily unavailable for maintenance or due to factors outside our control. Forge AI provides general fitness and nutrition guidance, not medical advice.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with these Terms or the Service is capped at the amounts you paid us in the six months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including for fraud, death, or personal injury caused by negligence.

You agree to indemnify and hold harmless xlc fitness and its officers, employees, and agents from claims, damages, and expenses arising out of your content, your unlawful use of the Service, or your breach of these Terms.

We may update these Terms from time to time. Where changes are material, we will provide notice within the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the jurisdiction in which xlc fitness is established, without regard to conflict-of-law principles. Any dispute arising out of these Terms will be subject to the exclusive jurisdiction of the courts of that jurisdiction, except where local law requires otherwise.

You may not assign or transfer your rights or obligations under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or part of our business.

We are not liable for failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, outages of third-party services, or government action.
